Have you ever heard of an authority that is constituted without any law or legal sanction? This occasionally happens in India and the most glaring example of the same is the unique identification authority of India (UIDAI).
UIDAI is entrusted with the task of implementing the Aadhar project of India or the UID project of India. The Aadhar project is the most controversial and highly surveillance capable project of India.
It has been portrayed as a welfare scheme but the reality is that it is an instrumentality in the hands of Indian government and its agencies to indulge in unreasonable, unconstitutional and unaccountable e-surveillance and surveillance in India.
Nandan Nilekani tried to use the traditional method of time gaining by declaring that he would come out with a privacy law and data protection law. All he ended up with is a National Identification Authority of India Bill 2010 that still makes both aadhar project and UIDAI “Unconstitutional” and illegal. Time has come to scrap Aadhar project/UID project and disband UIDAI as suggested by experts.
